Terms & Conditions
Effective date: May 19, 2026
1. Acceptance of terms
By accessing or using nursinghomematch.com (the “Site”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use the Site. If you use the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
2. About the service
Nursing Home Match is an independent, non-commercial directory that aggregates publicly available government quality data on nursing homes in the United States (sourced from the U.S. Centers for Medicare & Medicaid Services Care Compare program) and on residential aged care homes in Australia (sourced from the Department of Health, Disability and Ageing Star Ratings program, distributed via GEN Aged Care Data / AIHW).
We are not a healthcare provider, broker, placement agent, or referral service. We do not sell leads to facilities, do not earn commissions, and do not accept paid placement.
3. No medical, legal or financial advice
Content on the Site is provided for general information only and is not a substitute for professional medical, legal, or financial advice. Star Ratings and Five-Star Quality Ratings are one indicator of quality among many; they do not guarantee the experience an individual resident will have at any facility. Always consult qualified professionals and the relevant government tool — Medicare.gov Care Compare in the US or myagedcare.gov.au in Australia — before making care decisions.
4. Independence and attribution
Nursing Home Match is not affiliated with, endorsed by, sponsored by, or operating in partnership with the U.S. Centers for Medicare & Medicaid Services, the U.S. Department of Health and Human Services, the Australian Government, the Department of Health, Disability and Ageing, the Australian Institute of Health and Welfare (AIHW), or any nursing home or aged care provider listed on the Site. Government dataset names and agency names are used only for source attribution.
5. Acceptable use
You agree that you will not:
- Use the Site for any unlawful purpose or in violation of these terms.
- Scrape, harvest, mirror, or systematically extract content except where expressly permitted by the licences in section 7 or applicable law.
- Submit malicious code, attempt to gain unauthorised access, or interfere with the security, availability, or integrity of the Site.
- Use the Site to develop a competing commercial product without our prior written consent.
- Misrepresent your affiliation with us, any facility, or any government agency.
- Use automated systems that send more requests than a typical human visitor would in a comparable period.
6. Intellectual property
The Site’s design, original copy, code, interface, logos, and aggregated presentations are © 2026 Nursing Home Match unless otherwise noted. All rights are reserved except as expressly granted in these terms.
Subject to your compliance with these terms, you may view, save, and print pages from the Site for your personal, non-commercial use. Any other reproduction, redistribution, or commercial use requires our prior written permission.
7. Government data licences
- United States: The CMS Care Compare “Provider Information” dataset is U.S. Government work and is in the public domain. No additional licence is required to reuse the underlying values; attribution to CMS is appreciated but not required.
- Australia: The Star Ratings Quarterly Data Extract is published by the Department of Health, Disability and Ageing via GEN Aged Care Data and is licensed under Creative Commons Attribution 4.0 International (CC BY 4.0). We have modified the data for presentation (filtering, sorting, aggregation, ranking, and visual display) but rating values themselves are unchanged from the source extract.
8. Accuracy and timeliness
We import data from official government sources on a regular schedule, but the data on the Site may not reflect the most recent inspection, sanction, ownership change, or other update. The Site is provided on an “as is” and “as available” basis. We do not warrant that the content is current, complete, error-free, or fit for any particular purpose. Before relying on any information for a care decision, please verify it directly with the relevant government source and the facility.
9. Third-party links and content
The Site contains links to third-party websites operated by government agencies and care providers. We do not control those websites and are not responsible for their content, privacy practices, or availability. Inclusion of a link does not imply endorsement.
10. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Site and all content are provided “as is” without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation. Nothing in these terms is intended to exclude or limit any consumer guarantees that cannot lawfully be excluded under the Australian Consumer Law or comparable laws in your jurisdiction.
11. Limitation of liability
To the maximum extent permitted by law, Nursing Home Match and its operators, contributors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or substitute services, arising out of or in connection with your use of (or inability to use) the Site or any information on it, even if advised of the possibility of such damages. Our aggregate liability for direct damages will not exceed one hundred U.S. dollars (USD $100).
12. Indemnity
You agree to defend, indemnify, and hold harmless Nursing Home Match and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these terms or your misuse of the Site.
13. Changes to the Site or terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these terms; the “Effective date” will be updated when we do. Your continued use of the Site after a change takes effect constitutes acceptance of the revised terms.
14. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. You agree that any dispute will be resolved exclusively in the state or federal courts located in Delaware, except that consumers ordinarily resident in Australia or the European Union retain any non-waivable rights under their local consumer-protection laws.
15. Severability and entire agreement
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These terms, together with our Privacy Policy, constitute the entire agreement between you and Nursing Home Match regarding the Site.
